Pls note that Maritime Labour Convention 2006 (MLC 2006), internationally effective since August 2013, was ratified by Argentina last year (Act 26920) and shall become in force in our country as from May 28th, 2015.
The aforementioned Convention determines the rights of seafarers as regards living and working conditions on board, including among other aspects, minimum age, hours of work and rest, employment agreement, payment of wages, complaint procedures by seafarers, repatriation after contract expiration, medical care, accommodation, food and health, safety and accident prevention, etc.
Although the Ministry of Labour, Employment and Social Welfare is the Enforcement Authority, Coastguard signed an agreement with Labour Authorities assuming responsibilities in the implementation process on the issuance of medical certification, security control, qualifications of seafarers, verifications on structural conditions of vessels, among others, for flag vessels and also the supervision of foreign vessels operating within the country by means of international guidelines on Port State Control (PSC) regimes. This situation could lead to higher rates of vessels detention by PSC officers due to the non compliance with the PLC terms.
